Mirena IUD Lawsuit Update: Bernstein Liebhard LLP Reports on Recent New Jersey Supreme Court Ruling

The New Jersey Supreme Court has denied Bayer Healthcare Pharmaceutical’s petition to have all Mirena IUD lawsuits filed in the state consolidated in a single proceeding in Middlesex County Superior Court. In a notice dated January 8th, the Court directed that all Mirena lawsuits should continue to be filed in appropriate counties of venue. Mirena IUD Lawsuits

Bayer petitioned the New Jersey Supreme Court for consolidation of Mirena lawsuits in August 2012. According to the petition, 16 Mirena lawsuits were pending in New Jersey at that time, most in Morris County. Seven additional lawsuits were pending in courts around the country. All of the claims allege plaintiffs suffered serious Mirena complications as a result of misplacement of the IUD, according to Bayer.**

The Mirena IUD is a small, hormone-releasing, t-shaped device that is inserted into the uterus by a healthcare provider, where it may remain for up to 5 years. Mirena was approved as a contraceptive by the U.S. Food & Drug Administration (FDA) in 2000, and is now used by some 2 million women, according to Bayer. In 2009, its approval was expanded to include treatment of heavy menstrual bleeding in women who wish to use an IUD as their method of birth control. That same year, the FDA issued a warning letter to Bayer after finding that one of its Mirena promotions overstated the IUD’s benefits and minimized its risks.***
