Arrest Warrants Issued; US Marshals Look for Tennessee Pastor and Assistant

On July 5, 2012, Defendant, Pastor Walter “Chick” McGill received notice from an associate in Uganda that an arrest warrant had been issued, and US Marshals are looking for him in Tennessee.  Pastor McGIll and his church assistant, Lucan Chartier, have been sanctioned for their civil disobedience respecting the use of the name of their religion – Creation Seventh Day Adventist.

After returning to the USA from a four-year humanitarian projects mission in Uganda, Pastor McGill along with his assistant received notice of a court order authorizing US Marshals to take them into custody if they did not comply with a permanent injunction to cease and desist using their religious name on the Internet and Church house advertising. Though the pastor could have fled back to Uganda wihout event, he was counselled by God to face the consequences of his consciencious obedience to the requirements of His Maker.

The Court has ruled that “Creation Seventh Day Adventist” violates the trademark SEVENTH-DAY ADVENTIST which is owned by the General Conference Corporation of Seventh-day Adventists in Silver Spring, MD. Since the pastor and members of the religion hold the name “Creation Seventh Day Adventist” as a sacred and divinely-mandated testimony of faith, none of the court orders and sanctions have been complied with. More than $70,000 in monetary sanctions have been ordered against the Defendant.

The lawsuit began in 2006 and has reached the US Supreme Court, though the high court declined the petition without comment.  The Sixth Circuit Court of Appeals handed down an opinion favoring the General Conference SDA Church based on a technicality.  The RFRA defense claimed by Pastor McGill was ruled inapplicable since the conflict did not include the government as a party to the lawsuit.  Other circuit courts have ruled on RFRA claims in lawsuits between private parties yielding different results from that of the Sixth Circuit.  The Defendant has exhausted all modes of appeal.

Pastor McGill has said he will fast from consuming food during the time of incarceration, and he intends to turn himself over to the authorities in the Los Angeles, CA jurisdiction sometime in July.
