‘Loud Music’ Self Defense Shooting Had Nothing To Do With Race

The court case of Michael Dunn shooting Jordan Davis in a gas station parking lot on November 23^rd, 2012 finally wrapped up this week. The main line item coming out of various media outlets is that this shooting was racist because Dunn was not convicted of first-degree murder, but instead was convicted of 3 counts of attempted second-degree murder and one count of firing into a vehicle, giving him the possibility of 75 years in prison.

The jury did not convict him on a count of first-degree murder due to the prosecution not being able to prove that Dunn did not act in self defense for the first 3 of 10 total shots on the Dodge Durango that night.

Florida’s Stand your ground law explicitly states that, “…has no duty to retreat and has the right to stand his or her ground and meet force with force, including deadly force if he or she reasonably believes it is necessary to do so to prevent death or great bodily harm to himself or herself or another…”

We will never know if Jordan Davis did have a firearm like Michael Dunn claimed, but what is known is that the police never searched the surrounding area and the only witnesses in the case that claimed there was no firearm were the other 3 people in the car with Davis.

Put yourself in the same situation. You pull into a gas station to get something after going to your son’s wedding, your fiancé is sitting in the passenger seat, you ask someone in the vehicle next to you to turn their music down, they curse and insult you and then supposedly point a firearm at you and you respond with deadly force. How is any of that racist? Why does it matter if they were white or black or latino? What difference does it make to the facts of the case?

The issue isn’t one of racism, but was the shooting justified and that’s not the primary focus. Instead multiple articles from major news sources compare this case to the Zimmerman case of last year and making a connection between these two to make the reader think that young black men are the only reason Stand Your Ground laws exist in Florida. The truth of the matter is that Michael Dunn will likely spend the rest of his life in prison due to the events of that day and no one who has looked into his past has seen any racial-hate group affiliations or previous convictions of either violent or racist behavior out of the 40-something software developer.

If you reverse the roles of race where the person defending themselves was black and the teenagers in the car where white, what would the result be? Would the media still be crying out about racism instead of simply focusing on the facts of the case?
