The CAD File as Evidence: How 3D Reconstructions of Consumer Products End Up in Injury Cases

A decade ago, a product liability case leaned on the wreckage itself. Investigators photographed the failed part from every angle, cut it open, and asked a jury to trust a stack of glossy prints and a shop-floor diagram. That was the ceiling of the exhibit. Today, the exhibit is a rotating solid model on a courtroom monitor, cross-sectioned live, with the fracture surface highlighted and design intent overlaid straight from the manufacturer’s CAD file.

The shift changes what a designer, engineer, expert witness, or injured user should do the moment a product is suspected of causing harm. Physical evidence still counts. The digital twin of that product, and the workflow behind it, is often the piece the case turns on.

Reverse-Engineered Scans of the Failed Unit

The most common exhibit is a structured-light or laser scan of the actual product that hurt someone. A ladder rung, a folding chair hinge, a lithium-powered tool housing — the physical unit gets digitized into a mesh, then rebuilt as a parametric solid so an expert can measure wall thickness, weld penetration, and radii the eye can’t catch. The pipeline is the same one engineers use to recover a legacy part, aimed here at recovering what a part looked like the moment it failed.

The value in court is comparison. The scan of the fractured unit sits next to the manufacturer’s original CAD, and the delta — a thinner boss, a missing gusset, a radius ground away by a supplier change — becomes the story. A jury can watch that story instead of reading it.

The Manufacturer’s Own CAD Gets Produced in Discovery

The second category is the file the maker already has. Design history, assembly models, FEA runs, tolerance stacks, and revision logs are all electronically stored information, and in product cases they get requested. Modern product design generates a large volume of CAD files and simulation data, and once litigation starts those files raise real questions of format, cost, and proportionality in discovery.

For the design team, the CAD you shipped is the CAD a plaintiff’s expert will one day open. Rev notes matter. So does the reason a fillet shrank between v14 and v15. If the answer is “a supplier asked,” that answer is now discoverable.

Scene Reconstructions Place the Product in Context

The third category puts the product back inside the room, the vehicle, or the worksite where the injury happened. LiDAR sweeps of the scene get merged with the CAD of the consumer product, and suddenly the jury can see the exact sight line a user had, the height of the countertop the appliance sat on, or the angle at which a stroller tipped.

These composites are powerful, and courts know it. Judges have long been cautious about animations that can sway more than they inform, and trial courts are expected to examine proposed animation exhibits with care to confirm they are genuinely probative rather than merely persuasive. Foundation is the price of admission.

3D Prints Get Handed to the Jury

Once the model exists, printing it is trivial. A cross-section of the failed weld, scaled up ten times, sits in a juror’s palm. A safer alternative design — the guard that wasn’t specified, the retaining clip that would have cost pennies — sits next to it for comparison. The Expert Institute’s write-up on 3D-printed exhibits walks through how these tactile models are showing up in product liability, personal injury, and med-mal trials, and why holding an exhibit reads differently to a jury than watching one on a screen.

The tactile piece cuts both ways. A print made from a sloppy scan carries the same errors into the jury box, at scale. Expert witnesses have started noting scanner accuracy on the record for that reason.

Every File Has to Clear the Reliability Bar

None of these exhibits get in automatically. Federal Rule of Evidence 702 governs expert testimony, and the 2023 amendments tightened the reliability standard courts apply — the proponent has to show that the methodology, and the way it was applied to the facts, is more likely than not sound. For a CAD reconstruction, that means documented scanner calibration, a chain of custody on the file, and an expert who can explain every step from point cloud to solid model.

For an injured consumer, the practical takeaway is smaller than the doctrine sounds. If a product hurts you or someone in your family, two moves are worth making right away:

  • Preserve the product. Bag it, tag it, don’t clean it, and don’t let the retailer take it back for a refund. That physical unit is what a scan will one day be built from.
  • Get help early. A car accident attorney or product-injury lawyer can put the manufacturer on formal notice before design files are archived or overwritten, which is when discoverable CAD tends to slip away.

For the people who make the products, the message is the same one CAD teams have been hearing about traceability for a decade, with sharper teeth. The file you sign off on is a document that may one day be an exhibit.
