Your Life is Now Classified: NSA Rejecting All FOIA Requests by American Citizens

Clayton Seymour, a 36-year-old IT specialist from Hilliard, Ohio, recently sent a Freedom of Information Act (FOIA) request to the NSA, curious as to whether any data about him was being collected.
What he received in response made his blood boil.
“I am a generally law abiding citizen with nothing I can think of that would require monitoring,” Seymour wrote to me, “but I wanted to know if I was having data collected about me and if so, what.”
So Seymour sent in an FOIA request. Weeks later, a letter from the NSA arrived explaining that he was not entitled to any information. “When I got the declined letter, I was furious,” he told me. “I feel betrayed.”
Seymour had decided to request his NSA file after coming across a recent post of mine instructing Americans on how to properly request such files from the FBI and NSA. A Navy vet and two-time Obama voter who supported the President’s platform of greater governmental transparency, Seymour was shocked by the letter he received.
The letter, which first acknowledges the media coverage surrounding its surveillance systems, quickly moves to justify why none of that data can be obtained by an American citizen in a standard FOIA request:
Seymour isn’t the only one who has recently had an FOIA request denied by the NSA – dozens of citizens have emailed me to say they’ve received a similar, if not identical, letter. And it’s clear from the exemption the NSA is using that every single American is having their FOIA requests similarly rejected.
Unjustly so.
It should be noted that there are legitimate exemptions to the Freedom of Information Act, the first of which states that documents requested may be denied if they are “properly classified as secret in the interest of national defense or foreign policy.”
However, the central problem is this: Seymour’s letter from the NSA points to Executive Order 13526, signed by President Obama in 2009, as justification for the NSA’s FOIA exemption.
This order signed by Obama established a uniform system for classifying national security information, and stipulates that “information shall not be considered for classification unless its unauthorized disclosure could reasonably be expected to cause identifiable or describable damage to the national security.”
This qualification appears in section 1.4 of the executive order, after which follow many categories of information which maybe marked as classified. The category the NSA points to in justifying the classification of all its data is this:
(c) intelligence activities (including covert action), intelligence sources or methods, or cryptology
Meaning: the NSA is classifying every single bit of data it receives from ordinary American citizens based on the premise that it has been gathered covertly.
Meaning: the NSA’s advertised justification for not granting FOIA requests is to protect our country. However, the real justification is the NSA’s covert violation of Americans’ Fourth Amendment right not to be subject to unwarranted searches and seizures (in this case of their personal, digital data).
The NSA, it seems, has classified every single piece of data on American citizens that it has seized and saved, even benign data culled from people like Seymour, who are no threat to U.S. national security.
“I believe in the concept of America,” Seymour told me. “[But] not its current execution.”
I sense the Founding Fathers would agree with him.

Can you not get a subpena on the grounds of that disclosure since you are a. not a threat and b. it was obtained by a third party which did not disclose it was collecting
data on you and it is grounds for fraud?

Ok. Just one more before work. Short and sweet one. The request to information is rejected because a citizen is nothing more than an extended British Subject. No, you say? It’s all history. The average flesh and blood Man or Woman was not recognized in the various treaties and CONstitutions written over time. They only recognize STATES (Estates) for the power and status for commerce. WE the people, are not recognized by federal (read contract is the true meaning of the word) government (read corporation as the true meaning of the word) because we agreed to be under their deceitful and lying authority. Hmmmmm…. well I guess the first emotion this article is supposed to provoke is rage. The second emotion this is supposed to provoke is fear. What do people do when they are afraid or angry? They react emotionally and in somewhat of a traumatized state. Trauma creates a numbed state of mind because this is how the body and mind compensates for the fight or flight response.
I’m not sure what it is going to take for people to realize this kind of crap is distracting them from dealing with actual problems like low wages and lack of jobs but that’s exactly what its doing. It’s fun to read these articles and it may even be true.
The only way Washington and these terminally rich people are going to change their behavior is with blackmail, jail or armed conflict. Nothing ever changes without taking down giants with a police action, armed conflict or blood being spilled and unless people are ready to get serious and organize… as far as I’m concerned… shut the hell up.
We are getting the government we are tolerating. They tax us at 30% of our income, do nothing but kill people overseas with our money and we sit here and do nothing. I don’t see people demanding the arrest of the head of the NSA for virtually breaking into our homes, or unauthorized access of a private computer.
If you break into a private computer – your ass is going to jail. Why isn’t every agent of this organization sitting in a jail cell right now? They have taken our information in an unauthorized way and they are a bunch of criminals. So sit back and relax and wait for the drone watching you have sex with your wife while a 20 year old pervert government employee watches you conceive your next child – cowards.
As long as we are at war, Obama has a lot of power he wouldn’t have if we were at peace. That’s why he wont get us out of Iraq and Afghanistan and is looking for the next fight.
It is only in times of war the executive branch has the kind of power they are playing games with now under the law. Those executive orders without congressional approval mean very little legally.
What you focus on in legal matters with the Government is the separation of powers and you need good lawyers that understand constitutional law.
You also need a whole bunch of people or a “class” of citizens affected by the corrupt actions of any governmental administration to get anywhere. You have to establish they have broken the law which in a lot of cases is easy to do.
The NSA is “illegally obtaining access to private computers”.
If you or I did that we would go to jail. You can demand the arrest of these criminals for unauthorized access to your private computer. It is the law and they know they are breaking the law…especially if you have a business.
The NSA can keep my data and I have an as$ they can kiss as well. What they heave done and are doing is a crime and the US Constitution is clear on that fact.
Actually, you’re wrong and it is “legal” based on their definitions. If an adversary or enemy will benefit from the release of your information and how they got it then they are within legal rights to not tell you. Here’s the “thing”: what if they consider YOU the adversary or enemy and YOU (and 350 million other “AMerikan Citizens/Comrades”) the national security threat? Then giving you that info and telling you how they got it might benefit you (and the rest of us) in some way. Get it? WE are the “adversaries” or enemy or target. Pick your favourite war word. It’s MEANT to be used against us!
