Now let’s discuss the “right to carry” case, that Scott Bach and Thomas Rogers are pursuing, which encompasses being able to defend yourself with a firearm outside of your home. May 23rd is when the case goes to conference before the Supreme Court, and if you’re Googling 2A litigation of interest to you, it’s called “The Rogers case” (a.k.a. concealed carry.) Now, a conference doesn’t mean we will know what they are going to do with the case, but it does mean that the Justices will consider what to do with the case, amongst themselves. However, they will announce the action they’ve agreed upon on May 28, 2019. Scott said, “Normally, it would be the following Monday after conference, but that’s Memorial Day.”

New Jersey judges and lawmakers have disparaged the Second Amendment for civilians seeking a permit to carry a concealed firearm, FOR DECADES. The ANJRPC is the lead plaintiff in the next right to carry case, and If you’ll recall, the State of New Jersey ignored the original petition. If SCOTUS wanted to, they could have let the case die without opposition. Instead, the Supremes reminded the New Jersey Attorney General that there ain’t no mountain high enough to keep them away from this case and mandated that New Jersey file a brief. According to Scott’s summary of the case so far, “We are going to know within a week or two, whether the Supreme Court is going to dispense with it, deny it, allow it or do something else.”

There are three (maybe four) possible (but hopefully not probable) directions that the Supreme Court might go with the merits of the case. They can deny or dismiss the case, but Scott thinks that it would be unlikely for them to do so. Since they’ve already had the opportunity to deny it, it would be extraordinary for them to have a conference for a dismissal. Next, they could delay their decision and “re-list” the case, which means they would put the case off until the next conference. They could also delay the case by holding up the review of the case, pending the outcome of similar cases that are being heard, like the one in New York City that is currently pending. The opposite of dismissing the case (the thing that what we want) would be for them to agree to hear the case.

Sandy pointed out that the antiquated gun laws, which are being used to put law-abiding citizens in legal jeopardy, actually stem from the “Jim Crow” era. While labeled constitutionally “equal” a SCOTUS from long ago (and thankfully far away) deemed that African-Americans, immigrants, and even Native Americans, should have separated, or segregated, facilities, jobs and other inhumane inequities of otherwise common societal mores. Basically, they were making minorities invisible; in restaurants, in schools, and on voting ballots. “Jim Crow” laws were a detestable affront to humanity and would eventually be deemed as such, by clear thinking Americans during the civil unrest that plagued the 20th Century South. More specifically, the term marks a particularly dark time in American History when the elites decided that they would legally enforce civil rights infringement, on people that were underrepresented in the legislature. The goal was to keep the “unwashed masses” ignorant and subjugated.

Times have changed, and we like to think that we are a more civilized society now, and that we’ve squelched ethnically biased segregation. While that may seem convincing on the surface, the facts of the matter are that we are still suffering from a form of segregation, where the rich get to make the rules and the proletariat get to pay more taxes to subsidize the people who make the rules. Imminently destructive forces are attempting to rob law-abiding Americans of their right to bear arms, as provided for in the U.S. Constitution. The cold hard truth is that lower-income families are again becoming invisible, and they are being left out of the discussion while being punished for protecting themselves in dangerous situations. This is why we need patriots the ilk of Scott Bach and the members of the ANJRPC, to amplify our voices.
