Wayne County Charter Amendment proposal to change the membership of the Wayne County Pension Commission
A YES vote allows the retirees and employees of the Wayne County Airport Authority to become full members of the retirement system by giving them the right to vote and serve as members of the retirement commission (not more one member of the Airport Authority would be able to serve on the Board), expands the governing board by adding the County Treasurer as the ninth member, and allows the Chair of the County Commission (who is a member of the Commission) to appoint an person to serve as his/her designee on the commission.
A NO vote continues to exclude airport employees and maintains current membership in the governing board.
Explanation – This amendment has three components:
- Allowing members of the Wayne County Airport Authority retirees and employees to vote and serve as members of the pension board. Currently, the Wayne County Airport Authority retirees and employees can currently enroll into the county pension system; however, they do not have the right to vote on the leadership of the board nor can they serve as members of the board. If passed, this amendment would now provide them with the opportunity to vote and serve as a member of the board.
- Allow the Chair of the Commission to appoint a designee. While the Chair of the County Commission is a member of the Pension Commission, he does not have the right to appoint a designee to serve in the event that he cannot attend a meeting. If this amendment would pass, the Chair would have the ability to appoint a designee.
- Add a 9th member to the Pension Commission. Pension Commission currently has an eight member body with very complicated tie breaker rules. Therefore, it is believed that by adding the Treasurer to the Pension Commission, increasing the number of members from 8 to 9, would help with tie breakers.
Wayne County Charter Amendment proposal to give the Governor authority to remove the Wayne County Executive from Office
A YES vote allows the governor to remove the Wayne County Executive for the same reasons and same due process as provided by law for the Sheriff, Prosecuting Attorney, County Clerk, Register of Deeds, and County Treasurer.
A NO vote means that the charter continues to have no language regarding the removal of the County Executive
Explanation – Currently there is no language in the County Charter or the State Constitution that allows for the County Executive by any other method other than a recall. While this proposal would amend the County Charter to allow the Governor to remove the County Executive, the Executive contends that the Charter Counties Act, 293 of 1966 does not provide that a county can place in its charter a provision for the removal of the Chief Executive Officer other than recall. However, nor does the Charter Act state that that a county cannot place in its charter a provision for remove of the Chief Executive Officer by the Governor. It is believed that if this amendment was to pass the State Legislature may have to amend the Charter Act to allow the removal of the Executive by the Governor.
Wayne County Charter Amendment Proposal to have the Wayne County Commission determine the format of county budget
A YES vote would authorize the County Commission rather than the County Executive to set the form of the county budget (including but not limited to lump-sum and line item) and the appropriation ordinance.
A NO vote means the format will continue to be determined by the County Executive.
Explanation – The County Commission would like to have a line item budget or at very least a hybrid between a lump-sum and line item budget to help detect and eliminate waste, fraud and abuse. For example, this would allow the commission to identify how many political appointees are being paid out of each individual department.
Wayne County Charter Amendment Proposal to give the Wayne County Commission authority to approve compensation for county employees.
A YES vote grants the County Commission authority to approve compensation for all compensation of every employment position in the county, unless the compensation is established by state or federal law.
A NO vote keeps the authority with the County Executive except when compensation is set by state or federal law or collective bargaining agreements.
Explanation – Currently County Commission already has to approve all collective bargaining agreements; this proposal would expand the commission’s authority over non-union employees (political appointees, department heads, etc.). The Commission is seeking this authority to insure that all severance packages must be approved by
the commission; simply put no more Turkia Mullins.
Wayne County Charter Amendment proposal to change limitations on external auditors contracted to provide reports on Wayne County finances.
A YES vote eliminates the 8-consecutive-year restriction currently in effect for external auditing firms and would continue to require competitive bidding in their selection.
A NO vote continues to limit external auditing firms to a maximum of 8 consecutive years and require competitive bids.
Explanation – This amendment would not change the process that the county uses to select an external auditing firm. However, it would lift the eight consecutive year cap currently in place. The argument for this amendment is if an auditor that is doing a good job why should you be forced to sever ties? The argument against this proposal is that in order to maintain the integrity of the auditor, the county should keep the eight year cap.
