The Death Of One Man

The election of one man began the fundamental transformation of America and the death of another may complete the transformation. The death of Antonin Scalia may very well bring the death of our Constitution.

Antonin Scalia has been standing between us and tyranny for 30 years. He was a remarkable man in so many ways but an especially remarkable jurist. To the dismay of the opposition, Scalia’s dissents were clear, logical, factual and strictly Constitutional. Scalia’s dissents on Obamacare and Gay marriage should be required reading. He was an originalist who believed the founders meant exactly what they wrote. He didn’t believe the Constitution was a living, breathing document that could be changed by the whims of current opinions. And contrary to the opinions of many on the Left, Scalia’s belief is supported by the Federalist papers. He didn’t believe the Supreme Court could make laws but that they were tasked to uphold the intent of the Constitution.

Over the years the Supreme Court has been used to change laws and that has made the Court much more powerful than our founders intended. They have been allowed to decide controversial issues Congress is unwilling to solve legislatively. Too many times these are five to four decisions which gives one judge the power to decide our fate. We are losing our power to govern ourselves and no one was more aware of that than Justice Scalia. He passionately defended innocent human life, the natural family and religious Liberty. Who will now?

I was privileged to have met Justice Scalia at an event at the Reagan Library. I thanked him for his dissent on Obamacare. He said it didn’t matter much. I told him because he explained so logically why Obamacare was unconstitutional when it fails people will understand why.

We are at a place where the appointment of one Justice could shift the course and destiny of this nation. There are six cases before the court that could have devastating effects on the country. On man, one vote; abortion; religious freedom; separation of powers, affirmative action and the right to work. As most of us know, the court hears the arguments between October and April and announces the decisions in June. It is my understanding that if a Justice is not present when the decision is issued, his vote doesn’t count. We already know the court placed a stay on Obama’s EPA overreach until the decision is issued. Without Scalia the EPA could be allowed to continue it’s war on coal (40% of our energy needs).

Right now we really only have two Conservatives on the court we can trust to uphold the Constitution, Thomas and Alito. We can’t trust what Kennedy or Roberts will do. But we do know how the four Liberal Justices will vote. They’ll vote for what they want the law to be rather than it’s constitutionality.

If more Liberals are appointed to the Supreme Court I have no doubt we will lose the First and Second Amendments. I mourn the loss of Justice Scalia as I fear for our country. May God bless us.
