“A Nation Ceases To Be A Nation If It Can’t Protect Its Borders”: Fifth Circuit Backs Trump’s Mandatory Detention Policy

A federal appeals court handed President Donald Trump’s administration a significant immigration enforcement victory Friday, ruling that illegal immigrants detained within the United States have no constitutional right to a bond hearing, regardless of how long they have lived in the country.

In a 10-7 decision, the 5th U.S. Circuit Court of Appeals in New Orleans upheld the administration’s detention policy, reversing an earlier panel ruling and limiting legal challenges that had allowed detained migrants to seek release.

The decision affects immigration cases in Texas, Louisiana and Mississippi, strengthening the administration’s authority to detain illegal immigrants while deportation proceedings are underway.

Writing for the majority, Trump-appointed Judge Cory Wilson determined that migrants who entered the country illegally remain legally classified as seeking admission and are not constitutionally entitled to bond hearings.

Wilson also noted that the individuals challenging their detention could end their confinement “at any moment by agreeing to leave the country.”

The case involved three illegal immigrants from Mexico and Honduras who were arrested by Immigration and Customs Enforcement following traffic stops. All three have American-born children, and one had lived in the United States for more than 22 years.

In a concurring opinion, Judge James Ho emphasized the importance of national sovereignty and border enforcement.

“A nation ceases to be a nation if it can’t protect its borders,” Ho wrote.

Ho also argued that the dissenting judges’ interpretation would create incentives for illegal immigrants to remain in the country unlawfully.

The seven dissenting judges maintained that the majority’s ruling improperly denied constitutional due-process protections to longtime residents.

Department of Homeland Security General Counsel James Percival celebrated the decision, calling it a “big win” for the administration.

The ruling reinforces a Trump administration policy implemented last year allowing federal authorities to hold illegal immigrants arrested inside the country until their immigration proceedings conclude, without automatically providing bond hearings.
