ATF Drops Registration For Suppressors And Short-Barreled Rifles Nationwide After DOJ Declines To Appeal
The ATF said Friday it will no longer require anyone to get federal approval before making or transferring suppressors, short-barreled rifles, short-barreled shotguns or “any other weapons,” and will no longer require those items to be registered, in guidance that extends a Texas court ruling to every gun owner, not just the plaintiffs who won it.
“Effective October 9, 2026, ATF will no longer require individuals to seek ATF approval under the NFA” to make or transfer the items, the agency said in an open letter to licensed dealers, the Daily Caller reported. The letter adds that “these policies apply uniformly to anyone otherwise subject to these requirements, not just to the plaintiffs in the litigation.” A companion FAQ says Form 4 transfer applications are no longer required for the covered items.
The change follows a ruling by U.S. District Judge James Wesley Hendrix of the Northern District of Texas, who found on Aug. 5 that once Congress cut the transfer tax on these items to $0 in last year’s One Big Beautiful Bill Act, the National Firearms Act’s registration and approval scheme could no longer be justified under the taxing power. The decision covered the consolidated cases Jensen v. ATF and Silencer Shop Foundation v. ATF.
The injunction itself reached only the parties before the court. The Justice Department then decided not to appeal and to apply the ruling to everyone through enforcement discretion, according to American Rifleman. Rep. Andrew Clyde (R-Ga.) said on Aug. 12 that the administration would not appeal, and DOJ formally notified Congress in a letter released Oct. 1.
ATF Director Robert Cekada told the Caller that the injunction applied only to the plaintiffs and that the judge “was not able to go beyond his authority,” so the agency and DOJ worked to extend equal treatment through policy.
That is also the catch. This is an enforcement policy, not a repeal, so the statute remains on the books and a future administration could change course. Several limits remain:
- The $200 NFA tax and the full NFA regime still apply to machine guns and destructive devices.
- Dealers must still complete Form 4473s, run NICS background checks and keep records under the Gun Control Act.
- Interstate transport of short-barreled rifles and shotguns still requires ATF approval on a Form 20.
- State and local laws are unaffected, and ATF will keep processing NFA applications where a state still requires registration.

Other NFA challenges are still pending. ATF Chief Counsel Robert Leider said the guidance “will undoubtedly affect these cases,” though it is “hard to predict at this moment precisely what that effect will be.”
Gun Owners of America, which calls its challenge to the post-tax NFA the “One Big Beautiful Lawsuit,” hailed the guidance as exactly what gun owners had been waiting for. The group told supporters that the judge limited the injunction to the named plaintiffs “and their members and customers,” and that GOA members were among them. It said it had spent the weeks after the ruling lobbying the White House and Congress to press ATF to issue guidance.
According to the organization, if a future administration declared lawfully purchased suppressors and SBRs contraband, GOA says its members would still be protected by its court victory. ATF’s FAQ itself warns of that risk: ConcealedCarry.com reported that the agency describes unregistered items as contraband carrying felony penalties if enforcement resumes, and that federal law generally allows no after-the-fact registration unless the Attorney General declares an amnesty, which he is not required to do.
GOA credited its members, its allies in Congress, its co-plaintiffs and “President Trump and his administration” for the change, while noting that its larger goal is to abolish ATF and all gun control. “The NFA still exists, and gun control still is on the books,” the group said. “Until that changes, GOA will not stop fighting to protect and restore the Second Amendment.”
Clyde called the change the “biggest restoration of Americans’ 2A rights in history.”
