A former IRS officer stated the following:

After reading Peter Hendrickson’s eye-opening book, ‘Cracking The Code’, which explains in detail why an IRS officer would make such an unbelievable statement, we applied the principles outlined in the book and on his website, www.LostHorizons.com, overcame any FEAR, and received the refund, plus interest now acknowledged as owed to us by the government to us!

You may just have some money owed to you that you voluntarily (albeit unknowingly) gave to the government through fear and intimidation by their genius of legal fiction (The Tax Code). The Constitutional limitations of Excise and Capitation taxes (only) still stand (even with a careful reading of the Tax Code), despite the legal fiction subterfuge concerning the meaning of the 16^th Amendment.

This Week’s Featured Victory

LAST THURSDAY, NEIL AND DOREEN TURNER got a happy note in the mail– a check refunding every penny collected from them as “income” tax during 2012, plus penalties and interest, in response to the couple’s educated amended tax return. The $4,645.42 check represents an IRS reimbursement of what it had maintained was a $4,091.00 tax obligation for 2012, a failure to pay penalty, and interest allegedly owed to the government; plus interest now acknowledged as owed by the government to Neil and Doreen:

 

 

SO WHY IS THIS A “FEATURED VICTORY”? Just a simple, silly reason– in all my life I have only met one woman other than my own wife with the somewhat-unusual name ‘Doreen’, and I only know of two others, Doreen Turner being one of them, obviously. So, while I am always delighted for every victory on behalf of the rule of law, I’m especially happy for Neil and Doreen Turner!

Of course, I could mention that in this case the tax was being applied to what was being characterized as an early withdrawal from a so-called IRA. An “IRA” is a special retirement account which is relevant to the tax and entitled to that label because (and only if) it is made up of deposits of what qualify as “wages” under the special definitions of those particular kinds of payments in the tax law.

These specialized payments called “wages” are actually received by only a small fraction of Americans in the workforce. When Neil and Doreen made clear that they weren’t “wage” recipients, and thus their retirement account wasn’t actually an “IRA” and wasn’t subject to the tax at all, much less an “early withdrawal penalty”, with the following language on their Form 4852 accompanying their 1040X: “Funds derived from private-sector activity, not government connected or associated with exercise of government privilege,” the IRS obeyed the law and cranked out the refunds.

 Please join me in celebrating Neil and Doreen’s victory, which goes into the big stack with all the others secured and shared by upstanding and outstanding men and women who take their responsibilities as grown-up Americans seriously. Well done, friends!
