The Doctrine of the Lesser Magistrates provides the best means to rein in a higher authority that has abused its authority and spurned its limitations. The Doctrine of the Lesser Magistrates is rooted in Scripture and found throughout the history of mankind. The Doctrine offers great hope to a nation of people who groan under the yoke of tyrannical behavior by the State.

The Lesser Magistrate Doctrine declares that when the superior or higher ranking civil authority makes unjust or immoral laws, policies, or court opinions – the lower or lesser ranking civil authority has both the God-given right and duty to interpose and refuse obedience to that superior authority. If necessary, the lesser authorities may even actively resist the higher authority.

America’s founders established this nation as a true federalism. In a true federalism there are multiple levels of government and multiple branches on each level. They did this because they held to a Christian view of man – that he is wicked and in need of a Savior, namely Jesus Christ.

They did not want power to rest in one man or a small group of men.

The founders established a federalism so the various branches would check the others if they acted wrongly.

The intent, therefore, of federalism is: if any one branch begins to play the tyrant, it is the duty of the other branches to interpose and resist that branch – and stop the evil. (The duty of the people is to rally with the interposing magistrates).
