While official investigations have not established a formal government cover-up or proven direct Saudi state complicity, recent investigative reporting and newly surfaced evidence show that the FBI failed to fully pursue or disclose key material regarding suspected Saudi intelligence asset Omar al-Bayoumi. Omar al-Bayoumi, a Saudi student living in San Diego, provided significant logistical and financial help to two 9/11 hijackers (Nawaf al-Hazmi and Khalid al-Mihdhar) when they arrived in California in 2000. 

U.S. leadership and FBI officials have long maintained that while al-Bayoumi was a Saudi intelligence asset, he acted without prior knowledge of the hijackers’ terrorist plot. Declassified U.S. government files have not established a direct link or active planning role by the Saudi government. The Saudi government continues to categorically deny any complicity or prior knowledge of the September 11 attacks. 

The ongoing multi-district litigation, known colloquially as the 9/11 Terrorism Litigation, has moved forward aggressively following the passage of the 2016 Justice Against Sponsors of Terrorism Act (JASTA). A New York federal judge rejected Saudi Arabia’s attempts to throw out the case, ruling that plaintiffs presented legally sufficient evidence to proceed. The Saudi government has appealed the trial order to the U.S. Second Circuit Court of Appeals, with oral arguments scheduled for October 7. Plaintiffs’ attorneys have filed documents under seal alleging a pattern of witness intimidation by Saudi operatives during the discovery phase.
