After being held for eight and half months, Ms. Dark had been acquitted of drug related offences in 1989 in France. The prosecutor appealed the case without notifying Ms. Dark or her lawyer. The French judge overturned the acquittal despite no opportunity for Ms. Dark to present a defence at Appeals Court. A European Arrest Warrant was issued in 2005, so Ms. Dark would serve the sentence issued in 1990. Ms. Dark was arrested on three separate occasions between 2007 and 2009 in Turkey (at gunpoint), Spain, and the United Kingdom. Each time she was released based on the large passage of time from the appealed conviction. Ms. Dark could not travel outside the UK because the Warrant was still active in every Member State until it was removed by French authorities in 2010.

Subject to arrest in every Member State, despite EAW being dismissed several times before (violating Freedom of Movement).
