If the Police knock on your door...

By Tim Shoemaker
… be very, very, quiet.
That’s apparently the new standard set in place by an 8-1 Supreme Court ruling today. Today’s ruling is yet another example of the court’s willingness to subvert the once rigorous standards encompassed in the Fourth Amendment.
Supreme Court Justice Samuel Alito, writing for the majority, said police act properly if they “do not gain entry to premises by means of an actual or threatened violation of the Fourth Amendment.” Alito stressed that residents do not have to open their door to police, but if they generate suspicious noises inside, they create grounds for officers to enter.
“When law enforcement officers who are not armed with a warrant knock on a door, they do no more than any private citizen might do,” Alito wrote. “And whether the person who knocks on the door and requests the opportunity to speak is a police officer or a private citizen, the occupant has no obligation to open the door to speak. … Occupants who choose not to stand on their constitutional rights but instead elect to attempt to destroy evidence have only themselves to blame for the warrantless exigent-circumstances search that may ensue.”
Again, what this suggests is that we’d all do well to remember the catchphrase of Elmer Fudd if police knock on your door, “Shhhh, be vewy, vewy quiet…“
What are your thoughts on the courts new ruling?
