Georgia National Guard Member Faces DC Felony Firearm Charges

Zion Mitchell, a Georgia National Guardsman from Macon, Georgia, faces felony firearms-related charges, per DC Superior Court records reviewed by the author. 

According to a complaint filed by US Assistant Attorney Kathleen Kern on September 1, 2026, Mitchell’s arrest arose out of an incident that occurred on August 25 outside the Popeye’s restaurant located at 1226 H Street NE. On that date, Mitchell was part of a six-person Georgia National Guard element in a van parked on the street adjacent to the restaurant. The affidavit of Metropolitan Police Detective Jacob Krycia contains the following summary of the incident:

On August 25th, 2026, members of the First District Detective’s Unit were notified by the MPD-National Guard liaison that a National Guardsman had pulled out their gun and pointed it at another National Guardsman at 1226 H Street NE. The liaison advised that the Guardsmen were at their hotel in Virginia at the time, but that they would be brought back to the DC Armory on August 26th so MPD could investigate.

After interviewing multiple witnesses, MPD detectives interviewed Mitchell, who waived his rights and told detectives that 

… he was in a playful argument with Victim 1 when he pulled a pistol magazine out of his vest pocket and pointed it at her as part of the playful banter. During the course of the interview, Suspect Mitchell recanted that version of events, and stated that during the argument, he did pull out his pistol and point it in the direction of Victim 1, but that the pistol was pointed at a roughly 45-degree angle downward and not pointed towards her head.

Mitchell is currently being held without bond pending a September 15 felony status conference before Judge Robert J. Hildum. Mitchell is charged with Assault with a Dangerous Weapon, in violation of DC Code § 22–402, and Possession of a Firearm During a Crime of Violence or Dangerous Crime, in violation of DC Code § 22–4504(b).

An email sent to the Joint Task Force-DC media team asking for comment about who was in command of the unit at the time, Mitchell’s rank, and whether he might also face charges under the Uniform Code of Military Justice (UCMJ) elicited no response.

Georgia Department of Defense Media Director Major R. Dustin Cole provided the following statement to Cato on the Mitchell incident:

We can confirm that Spc. [Specialist] Zion Mitchell is a member of the Georgia Army National Guard. Due to the ongoing civil investigation and legal proceedings, we are unable to comment on the specific facts of the case or potential administrative and military actions at this time. 

The Georgia National Guard expects all service members to uphold the highest standards of professional conduct and safety. We take all allegations of misconduct seriously and will continue to fully cooperate with law enforcement authorities as the legal process proceeds.

There have been previous reports of deployed National Guard personnel assaulting and detaining at least one DC resident, but this is the first incident the author (himself a former National Guard member and commissioned officer) is aware of in which one National Guard member drew their service weapon on a fellow soldier and unit member. Pointing a loaded firearm at another person absent a direct threat of bodily harm or death violates military and civilian firearm safety training protocols and, in this case, local firearms laws. 

Such behavior represents a breakdown of good order and discipline in this particular episode, and it only highlights the continuing dangers of these unnecessary and politically toxic National Guard deployments in the nation’s capital.
