Italy - Covid decree: compulsory vaccine for over 50s, super green pass to go to the bank

In Italy, anyone over the age of 50 will have to get vaccinated in order to protect “public health and to maintain adequate safety conditions in the provision of care and assistance services”. The obligation is valid until June 15th. Cases of “ascertained danger to health”, certified by the general practitioner or by the vaccinator, are exempt.

Over 50, at work only with green pass

From 15 February, public and private workers - including those in the judiciary and magistrates – who have reached the age of 50, will have to show the Super Green pass at work, which is obtained with the vaccine or with the recovery from Covid. ”In order to protect public health and maintain adequate safety conditions in the provision of care and assistance services, the vaccination obligation for the prevention of SARS-CoV-2 infection, referred to in Article 3-ter, it applies to Italian citizens and citizens of other European Union Member States residing in the territory of the State, as well as to foreign citizens, who have reached the age of 50 “. It can be read in the draft of the legislative decree being examined by the CDM. ”The obligation does not exist in the event of an ascertained health hazard, in relation to specific documented clinical conditions, certified by the general practitioner or by the vaccinator, in compliance with the circulars of the Ministry of Health regarding the exemption from vaccination against SARS-CoV-2; in such cases, vaccination can be omitted or deferred. Immunization following a natural disease, proven by the notification made by the attending physician, determines the postponement of the vaccination.  The obligation exists until June 15, 2022 “ . In Italy there are 18 million over 60s, 28 over 50s. Workers between 50 and 64 amount to 8.2 million, while the unvaccinated between 50 and 60 are 2 million (aged 60 and over 1.2 million). 

At home without a salary

After five days of unjustified absence , workers without a Green Pass can be suspended without salary by their employer for up to ten days (but renewable until March 31, 2022) “for the duration corresponding to that of the employment contract stipulated for the replacement” . All companies will be able to replace workers suspended because they do not have Covid green certification. This is foreseen by the draft of the new decree on the table of the Council of Ministers which extends the measure initially envisaged for SMEs up to 15 employees. The replacement remains for “10 days, renewable until March 31, 2022, without disciplinary consequences and with the right to retain the job for the suspended worker”.

 Bank, beautician and hairdresser

To go to the bank, access PA services or personal services – see hairdressers or beauticians – it will be necessary to show the Super green pass, or be vaccinated or cured from Covid. But it is one of the points still under discussion. The League only asks for the obligation of a simple green pass

Sanctions

Article 4 of the draft of the decree on the new anti-Covid measures explains the measures envisaged for the extension of the use of vaccination and healing certificates in the workplace. ”For the violations referred to in paragraph 5, or” the access of workers to the workplace in violation of the obligation “of the super green pass, the administrative sanction is established in the payment of a sum from € 600 to € 1,500 and – it is added – “the disciplinary consequences according to the respective sector regulations remain unchanged”.

Antigenic tests to students

Free rapid antigen tests for first and second grade secondary school students subject to self-monitoring. A measure that, according to the draft, would apply until February 28 to “ensure the tracking of COVID-19 infections in the school population of lower and upper secondary schools, subject to self-monitoring”. A “suitable medical prescription issued by the general practitioner or pediatrician of free choice” will be needed and the test can be carried out “at pharmacies” or “health facilities adhering to the protocol of understanding”. 

“With at least four cases of positivity in the class” of lower secondary schools, as well as in upper secondary schools and in the vocational education and training system, “integrated digital teaching is applied to the same class for the duration of ten days”. ”Up to two cases of positivity in the class – we read again – self-surveillance is applied to the same class with the use of FFP2 type masks and with face-to-face teaching”.

Sport events

 There was no mention for stadiums and sports halls.
