Over Obama’s Forgery And Citizen Grand Juries

The leftist extremists at Southern Poverty Law Center, among other extremist outlets, are attacking Sheriff Arpaio for reportedly answering a question from a CA resident about a citizen grand jury for Obama’s forged birth certificate. SPLC attempts to paint Sheriff Arpaio, and birthers, as part of the Sovereign Citizens Movement.

Before we proceed.

It should be noted that the Southern Poverty Law Center spawned the domestic terrorist attack whereas some leftist extremist used SPLC’s Hate Map and went out and shot up the Family Research Council, with more attacks planned. The video embedded in their report is now set to private so we can only go by the word of SPLC & TRS.

SPLC: Arpaio Considered ‘Citizens Grand Jury’ for Obama Birth Certificate Probe, But ‘It’s a Little Tough’

Joe Arpaio, the controversial sheriff of Arizona’s Maricopa County, recently told a Tea Party gathering in California that he considered resorting to the “sovereign citizens” tactic of calling for a so-called “citizens grand jury” while he was conducting an investigation of the legitimacy of President Obama’s birth certificate.

The subject came up during an Arpaio speech on July 27 to a gathering of Tea Party conservatives in Ramona, Calif. A video taken by an audience member shows Arpaio being questioned about calling for a “sovereign citizens” tactic to be applied in a Maricopa County “fraud” case that “involved not only the perpetrator, Obama, but the senators, and congressmen, and … your secretary of state. Why don’t you form a citizens grand jury to bring indictments against these people, and when you get no response from it, then you can form a citizens trial court — ?”

The sheriff interrupted the man’s question.

ARPAIO: I heard about that. You know what I was looking at? It wasn’t for that. I was looking at it for the birth certificate. If I was gonna do a citizens grand jury, it would be because of that. 

It’s a little tough. Legally, it’s a little tough. You know, I am the sheriff, but I still have some restrictions. I gotta use a little common sense.

Now, here’s the reality of the situation, as I see it; All the so-called Birthers I know, which is a lot, just want the rule of law enforced, i.e., Article II, Section 1, Clause 5 of the U.S. Constitution. I haven’t done too much research on the sovereign citizens movement but from what I’ve read it is antigovernment. Would that not be contradictory to the goals of the so-called Birthers? I mean come on! We’ve been petitioning our government officials at all levels to take LEGAL action and protect and defend the U.S. Constitution, i.e., THE RULE OF LAW!

Contrary to SPLC’s Hatin, some states actually use citizen grand juries as noted by Ballot Pedia:


Laws governing citizen grand juries in Oklahoma

Oklahoma is one of six states that allow citizens to collect signatures on petitions in order to request a county grand jury to convene. Article 2, Sec. 18 of the Oklahoma Constitution and 38 O.S.1991 101 through 108 govern the process.

Article 2, Section 18
A grand jury shall be composed of twelve (12) persons, any nine (9) of whom concurring may find an indictment or true bill. A grand jury shall be convened upon the order of a district judge upon his own motion; or such grand jury shall be ordered by a district judge upon the filing of a petition therefore signed by qualified electors of the county equal to the number of signatures required to propose legislation by a county by initiative petition as provided in Section 5 of Article V of the Oklahoma Constitution, with the minimum number of required signatures being five hundred (500) and the maximum being five thousand (5000); and further providing that in any calendar year in which a grand jury has been convened pursuant to a petition therefore, then any subsequent petition filed during the same calendar year shall require double the minimum number of signatures as were required hereunder for the first petition; or such grand jury shall be ordered convened upon the filing of a verified application by the Attorney General of the State of Oklahoma who shall have authority to conduct the grand jury in investigating crimes which are alleged to have been committed in said county or involving multicounty criminal activities; when so assembled such grand jury shall have power to inquire into and return indictments for all character and grades of crime. All other provisions of the Constitution or the laws of this state in conflict with the provisions of this constitutional amendment are hereby expressly repealed.” [...] Via Ballot Pedia.

Petitions to impanel grand juries

Six states have laws allowing citizens to impanel grand juries through the process of collecting signatures on petitions: Kansas, New Mexico, North Dakota, Nebraska, Nevada and Oklahoma.

The most famous citizen-initiated grand jury in recent times was formed in Oklahoma after the 1995 Oklahoma City bombing, which killed 168 people. The citizens who collected signatures to impanel a grand jury in this case believed that Timothy McVeigh and Terry Nichols had been part of a wider conspiracy and that the government had not done enough to investigate. The grand jury they impanelled by petition found no evidence of this.

Examples of citizen-petitioned grand juries

Death of Jarret Clark in Wagoner, Oklahoma (2008)
April 18, 2008: Circulation of a petition to impanel a grand jury in Wagoner County, Oklahoma was approved on April 18 by Judge Bruce Sewell. The purpose of the grand jury would be to investigate the death of Jarret Clark, who died in 2006 under troubling circumstances.

The request to circulate the petition was made to Judge Sewell by Clark’s family. The family has 45 days to gather the approximately 3,000 signatures of registered voters needed to force the impanelment of the grand jury.

If the signatures are successfully collected, the county election board must certify them to the judge, who will then have 30 days to convene the requested grand jury.[3]

George Tiller abortion clinic in Kansas (2008)
May 7, 2008: The Kansas Supreme Court ruled on May 6 that a citizen-petitioned grand jury can proceed to investigate George Tiller’s Women’s Healthcare Services clinic, but must do so with oversight from a trial judge. Lawyers for Tiller had asked the Supreme Court to nullify the 1887 law that allows citizen-impanelment of grand juries.

7,000 signatures had been collected to impanel a grand jury in Wichita by Troy Newman of Operation Rescue West. The grand jury impaneled through this process issued a subpoena to the Tiller abortion clinic seeking 2,000 medical records. This action of the grand jury was contested by lawyers for the abortion clinic, leading to May’s ruling from the Kansas high court.

In January 2008, the Tiller grand jury issued a subpoena for records of every woman at least 22 weeks pregnant who had received or sought an abortion at the clinic for the past five years.

The opinion of the court said, “The court should satisfy itself that the grand jury has not engaged in an arbitrary fishing expedition” and imposed oversight by a judge of the inquisitive grand jury in order to ensure future compliance with the high court’s view of the matter.

A group of citizens in Albuquerque, New Mexico, is considering a petition to force the impanelment of a grand jury to investigate Judge Wayne Griego. They believe he is guilty of fixing traffic tickets for family and staff.

I would think Sheriff Arpaio researched all legal avenues/remedies to address Obama’s forged birth certificate. Not really sure what the SPLC and TRS are attempting to point out other than their obvious Hate for Sheriff Arpaio.

Maybe so-called Birthers in the 6 states above should start petitioning for grand juries just to piss off the SPLC?
