Let’s be clear, their scope of authority as a regulatory agency extends to the “REGULATION OF COMMERCE” under the “Commerce Clause” of the U.S. Constitution. Hence they can only regulate commerce… I.E. Gun dealers, engaging in commerce, holding a Federal Firearms License. Such people are obligated to adhere to this regulatory agency as “Terms of their licensing agreement”. That is precisely why they have such difficulty in regulating “Gun Shows”. The only people the have authority to regulate at Gunshows are “Gun dealers” “Businesses” holding a Federal Firearms License. They HAVE NO regulatory AUTHORITY or POWER over individuals, unless said individuals have entered into some other type of agreement or contract with the ATF.
This is the difference between “Color of Law” or “Having the Pretense of Being a Law” when it is in fact NOT a law at all. Again, Government’s derive their JUST POWERS by the CONSENT of those governed. Contrary to other Countries in the World… The united states of America have REPRESENTATIVES not RULERS.
