The Trump administration is hammering a federal judge for temporarily blocking its effort to end Temporary Protected Status (TPS) for South Sudan despite a recent Supreme Court decision that significantly narrowed lower courts’ authority to intervene.

U.S. District Judge Patti Saris on Thursday granted an administrative stay in African Communities Together v. Mullin , preserving TPS protections for South Sudanese nationals while she considers whether plaintiffs may amend their lawsuit and seek renewed relief on constitutional grounds.

The order temporarily freezes the administration’s Nov. 6, 2025, decision ending South Sudan’s TPS designation, keeping it “null, void, and of no legal effect” until jurisdiction returns to the 1st Circuit. Saris stressed that the order is a procedural measure to preserve the status quo while the court considers the plaintiffs’ latest filings and is not a ruling on the merits.

“Another rogue district judge just postponed the termination of TPS for South Sudan,” DHS general counsel James Percival wrote on X, slamming the decision. “This is open defiance of the Supreme Court, plain and simple!”

The SCOTUS decision in Mullin v Doe made it quite clear that these judges have zero authorization on the law to block or review the ending of any TPS. The Trump admin should simply, at this point, just ignore any orders. Oh, and house a butt-ton of these TPS folks in the judge’s neighborhood while awaiting repatriation. “Temporary”. Nothing else.

A newly-uncovered Biden White House memo from the administration’s final days revealed plans that could have expanded Temporary Protected Status (TPS) to more than 3 million noncitizens while acknowledging that previous court challenges had blocked many of President Donald Trump’s efforts to end the protections.

TPS is meant for foreign populations experiencing crises like political unrest or natural disasters, and while Trump has tried to end the “temporary” provisions for Haitians, Nepalese, Salvadorans and Sudanese people, lawsuits from pro-migrant advocates have halted most attempts.

“My investigation uncovered that the Lame Duck Biden White House tried to keep millions of illegal aliens in our country by abusing the ‘Temporary’ Protected Status program,” Sen. Eric Schmitt, R-Mo., who acquired the memo, told Fox News Digital on Friday.

The memo argued that “granting TPS will potentially protect many vulnerable people from President-elect Trump’s planned mass deportations… They argue that these protections are likely to hold in court, and they are prepared to litigate efforts to terminate or slow down the implementation of TPS for specified nations by the Trump Administration.”

And litigate they have! Despite the notion that TPS is temporary, and now that judges have virtually no authorization to block any efforts to end TPS and send people home, the lawfare will continue. It jams up the system, wastes time and resources, all in an attempt to keep them here and get the Trump admin to throw its hands up and say “too much, we’re done”, hoping that the next admin will be Democrat and keep them all here.
