Say no to dumping mining waste in Harlan County streams

Nally & Hamilton Enterprises is planning an 848-acre strip mine in Harlan County, Ky. and they need a permit to dispose of mine waste in headwater streams. The company has submitted an application for a Clean Water Act 404 permit to the Army Corps of Engineers. If granted, this permit would allow the company to construct two valley fills in the Upper Clover fork of the Cumberland River watershed. The streams that would be buried would never be restored.

With the coal industry in decline and several large Kentucky companies declaring bankruptcy in recent months, now is not the time to approve further destruction of Kentucky’s land and water. Surface mining not only harms the environment but also threatens drinking water and impacts the health of nearby community members.

Submit a comment to urge the Army Corps of Engineers to deny this application to bury streams with mining waste.
