Cause of action

A cause of action or right of action, in law, is a set of facts sufficient to justify suing to obtain money or property, or to justify the enforcement of a legal right against another party. The term also refers to the legal theory upon which a plaintiff brings suit.

The significance of the term lies in the fact that a trial can begin only after its existence is established. Clarifying a general legal issue with a specific Cause of Action is one of the trickiest questions to answer among the host of other questions related to any given case.

Cause of action is the legal claim [a claim that sometimes goes unstated] that allows a party to seek judicial relief. ^[1] This gives the legal right to seek a remedy because of the act or omission, failure to perform duty, or breach of obligation of the defendant towards the plaintiff. There must be certain legal implications to the rights of the plaintiff that result in the violation as per the facts and circumstances of the case. Attorneys can interpret this as an opportunity for the victim to seek equitable relief and compensation for the injury caused.

The elements required to constitute a specific cause of action are:

Unjust Enrichment

In laws of equity, unjust enrichment occurs when one person is enriched at the expense of another in circumstances that the law sees as unjust. Where an individual is unjustly enriched, the law imposes an obligation upon the recipient to make restitution, subject to defenses such as change of position.

Abuse of Process

An abuse of process is the unjustified or unreasonable use of legal proceedings or process to further a cause of action by an applicant or plaintiff in an action. It is a claim made by the respondent or defendant that the other party is misusing or perverting regularly issued court process not justified by the underlying legal action.

Breach of Contract

Breach of contract is a legal cause of action and a type of civil wrong, in which a binding agreement or bargained-for exchange is not honored by one or more of the parties to the contract by non-performance or interference with the other party’s performance.

Fraudulent Inducement Defenses. In the context of a breach of contract, the fraud claims is referred to as fraudulent inducement (a.k.a. “fraud in the inducement“). A party alleges that he or she would not have entered into a contract if the other party had not made fraudulent misrepresentations or had disclosed material information before …

Tort-related causes of action:

Fraudulent misrepresentation

The defendant makes a false representation regarding material fact;
The plaintiff relies on the fraudulent misrepresentation;
Results in the loss or injury to the plaintiff.

Tortious Interference

Tortious interference, also known as intentional interference with contractual relations, in the common law of torts, occurs when one person intentionally damages someone else’s contractual or business relationships with a third party, causing economic harm.

Prima Facie Tort
The elements of prima facie tort are: 1) lawful conduct not giving rise to an action for some other tort, 2) maliciously intended to harm the plaintiff, 3) and causing special damages 4) without justification. Prima facie in tort law aims to provide relief to plaintiffs (the injured party) for harms caused by others (defendants) who harm them with malicious intent,

The benefit-of-the-bargain makes the recovery of suffered harm possible in order to reinstate the position of the plaintiff considering the situation of correct representations.

Conversion

This is equivalent to intentionally depriving the interest of the plaintiff in property through the unauthorized act and causing loss. The default remedy is the damages, considering the fair market value of the property or returning the property.
