Habeas Corpus is one of the oldest Writs. It means “Deliver the body”. In the days of monarchs, the King might have someone disappeared. The noblemen were concerned about this, got an army together, captured the king, and insisted that the King sign an agreement which guaranteed the noblemen certain basic rights. One of the rights was the right to avoid being disappeared by the King. If the King had a nobleman detained, a Court composed of noblemen, each commanding a small army, could issue a writ of Habeas Corpus to the King, demanding that their fellow nobleman be brought forth, preferably alive, to present his case. It is my understanding that this particular alien was lawfully present in the United States. He had been ruled deportable, but not to El Salvador, where a Court had determined that his life would be in serious danger. His family, some of whom are U.S. citizens, invoked the right of Habeas Corpus, seeking to assure that their relative is in fact, still alive, and wishing to allow him to face his accuser, and speak in his own defense. All are rights secured by the Constitution. The right to face one’s accuser, to speak in your own defense, the right of Habeas Corpus, the right to due process of law. That Trump wants to deny those rights to this lawfully present alien is disturbing. Trump swore an oath to defend the Constitution, but it seems that he lied when he swore the oath, or he would not have an issue, with this individual having access to due process of law. If the individual is truly a criminal, and has harmed others, is it right to simply expel the perpetrator? Shouldn’t there be a trial, and imprisonment? The denial of trial, or even a Court hearing, shows Trump’s disrespect for the inalienable rights secured by our Constitution.
