Tufts Student in Critical Condition After Getting Hit by Car
Police in Somerville are looking for answers in a pedestrian crash that left a Tufts student in critical condition on Thursday night.
The 21-year-old student has been taken to Massachusetts General Hospital. He was critically injured after crossing Power House Boulevard at Packard Avenue, reports WHDH News.
The driver of the vehicle that hit the student is a mother. She had her three children in the car at the time of the accident.
She is reportedly cooperating with the police, says The Boston Globe.
The accident occurred at 8:20 p.m. According to police, there was at least one person standing at the intersection at the time of the crash. There was also another vehicle traveling behind the car that was involved in the crash, police say.
These eyewitness accounts could help police tremendously in piecing together the events that unfolded prior to the accident. One of the most critical pieces of evidence in a personal injury lawsuit in a car accident case is the police report.
At this stage, there have been no reports of anyone suing in this accident. Nevertheless, the police report details important information, such as speed at the time of the accident, who had the right of way and whether there were any factors that contributed to the accident.
For example, an eye-witness account could show that the pedestrian was crossing on a red light. In a personal injury case, this tiny detail could mitigate liability. Or even absolve the driver of any liability, in some cases.
Similarly, the condition of the street is important. Was the street well lit? Were traffic signs working properly? If the street lighting was poor, liability could be mitigated again, with a shift of liability to the city or municipality. The same goes for signage.
