While you’re still at the scene, if you can move around safely, shoot photos of everything. Both cars, where they landed, the intersection, skid marks, the weather. Grab the other driver’s insurance info and the numbers of anyone who saw it happen. One California thing people forget: you’ve got 10 days to report the crash to the DMV if anyone was hurt or the damage runs over $1,000. That’s almost every real collision, so just assume it applies to you.

Now the call you’re dreading.

A day or two in, the other driver’s insurance calls. Warm voice. Sounds genuinely worried about you. That person is paid to close your claim for as little as possible and they are very, very good at it. Don’t let the tone fool you.

They’ll ask for a recorded statement. You can say no. You usually should, at least until you actually know your rights. They might float a quick settlement that looks huge when you’re panicking about bills, and a $5,000 check feels like a lifeline right up until you find out the treatment’s going to run fifteen.

Watch this one specifically. The adjuster goes “so how are you feeling?” and you say “oh, better, thanks” out of pure reflex, because that’s what people say. Congratulations, you just recovered, according to the file. Tell them the truth about your injuries and quit reassuring them out of politeness.

Do you even need a lawyer, though? Honestly, sometimes no. Little fender bender, nobody hurt, barely a scratch? You can probably handle that yourself with your own insurer and save everyone the trouble.

It’s a pure comparative negligence state. Translation: even if the crash was partly your fault, you can still collect, your payout just shrinks by your share of the blame. Say you’re 30 percent at fault and your damages come to $100,000. You walk with $70,000. Partly your fault doesn’t mean nothing.

The filing deadline is two years from the injury for most injury suits. Feels generous. Then you blow a year on treatment and back-and-forth with the adjuster and suddenly it isn’t. And if a government body’s involved, a city bus, a pothole the county never fixed, that deadline can collapse to about six months to even file the claim. Miss it and it doesn’t matter how good your case was.

When you’re sizing up who to hire, it actually helps to see how a lawyer argues. Poke around an attorney’s courtroom background and you get a real feel for how these arguments get made, which beats guessing from a billboard.

Which brings me to picking someone. Choose carefully. The guy who did your buddy’s divorce is not the person for a bad crash case, even though they both passed the same bar exam.

Find a firm that does car accidents and injury claims, specifically, all the time. Ask how many cases like yours they’ve actually settled or taken to trial.
