Trump Signs Executive Orders Targeting Birthright Tourism, Protecting Citizenship

President Trump signed a pair of executive orders that he said were aimed at cracking down on birthright citizenship.

WSJ: President Trump signed a pair of executive orders that he said were aimed at cracking down on birthright citizenship, renewing one of his signature policies after the Supreme Court voided his earlier, broader bid to deny citizenship to many children born on U.S. soil to non-American parents.

The executive orders, which Trump signed in the Oval Office on Thursday, seek to expand the categories of people who are ineligible for birthright citizenship and ban tourists from coming to the U.S. solely to give birth.

“That includes, for example, alien enemies of the United States, members of foreign terrorist organizations and large categories of people who lobby and act on behalf of foreign governments,” per Stephen Miller “This ensures that large numbers of people who wrongly would be getting birthright citizenship will NO LONGER be eligible for those benefits.”

The first targets birth tourism, clarifying: It is therefore the policy of the United States to promote the integrity of its immigration system, to ensure that nonimmigrant visa classifications are used only for their lawful and intended purposes, and to prevent the exploitation of those classifications by persons engaging in birth tourism (White House).

In the second order, protecting citizenship, the order picks up on language from the Supreme Court’s Barbara decision: that the Citizenship Clause of the Fourteenth Amendment to the United States Constitution extends the privilege of citizenship to children born to parents in the United States “for whom no extraterritorial fiction applie[s]” (White House).

Stephen Miller explains the first: That practice of birth tourism is, as of the signing of this order, hereby banned. What that means is that no one in the world is anymore allowed to obtain a visa for this fraudulent purpose… of everything [@POTUS] has done that has been so unprecedented, I would put this in the top 3 in terms of importance because it ends what has been one of the gravest and most egregious abuses of the American system and it keeps American citizenship sacred” (Rapid Response).
