The DOJ declared the nearly 100-year-old statutory ban unconstitutional, arguing that the federal government and its postal service cannot infringe upon Americans’ Second Amendment rights by refusing to transport legal handguns. Acting on this guidance, the USPS drafted a proposed rule to lift the restriction.
If finalized, the regulation would allow law-abiding gun owners to transport handguns via the mail, though initial frameworks suggest specific limitations. Allow individuals to sell and ship a concealed weapon within state lines. Provisions published in the Federal Register indicate that for interstate transit, individuals may only mail a firearm across state lines if it is sent to their own care via another person, requiring the original owner to open the package. The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) has proposed parallel guidelines to ensure firearms are transported lawfully, on a short-term basis, and only where legal at the destination.
The proposed policy has created a sharp division among lawmakers and advocacy organizations. Groups like the National Rifle Association (NRA) view the change as a long-overdue victory for legal gun owners, streamlining the transport of personal property without arbitrary federal obstacles. Gun safety groups and a coalition of over 20 state attorneys general—led by officials from states like Michigan—have fiercely opposed the measure. Critics argue that allowing handguns in the postal system will fuel illegal gun trafficking, make it easier for criminals to bypass state-level background check laws, and severely hinder law enforcement’s ability to trace firearms used in violent crimes.
The USPS is currently evaluating public feedback and weighing the competing legal arguments before deciding whether to officially implement the rule change.
